Terms of Use

1. Introduction

1.1 These Terms of Use ("Terms") govern access to and use of the ParkCar platform (the "Platform"), including any website or mobile application operated by or on behalf of the Platform.

1.2 By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1.3 The Platform may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the updated Terms.

2. Platform Services

2.1 The Platform provides an online marketplace enabling users ("Users") to list, discover, and arrange bookings for parking spaces.

2.2 The Platform does not own, lease, control, or manage any parking spaces listed on the Platform.

2.3 Nature of the Platform. The Platform acts solely as a technology provider facilitating connections between Users seeking parking spaces and parking space owners. All payments are arranged directly between Users outside of the Platform, and the Platform is not a party to such transactions. The Platform charges service fees only to parking space owners for use of its services.

3. User Accounts

3.1 Users are required to create an account to access and use the Platform.

3.2 By creating an account, you agree that:

• you are at least 18 years of age;
• the information you provide is accurate and complete;
• you are responsible for maintaining the security of your account credentials;
• you will not create multiple accounts or share your account with others.

3.3 Users are responsible for all activities conducted through their account.

4. Listings and Landlord Responsibilities

4.1 Parking space owners ("Landlords") may create listings by providing accurate and complete information about the parking space.

4.2 Listing Verification. All parking space listings are subject to verification by the Platform prior to publication. The Platform reserves the right, at its sole discretion, to approve, reject, suspend, or remove any listing at any time.

4.3 The Platform does not guarantee the accuracy, completeness, legality, availability, or suitability of any listing. Any verification does not constitute an endorsement or warranty.

4.4 As a Landlord listing a parking space, you represent and warrant that:

• you have the legal right to rent the parking space;
• the listing information, including location, photos, and amenities, is accurate;
• the parking space is safe, accessible, and as described;
• you will honour confirmed bookings.

5. Bookings and Renter Responsibilities

5.1 A booking is formed when a User reserves a parking space through the Platform.

5.2 The Landlord is solely responsible for honouring confirmed bookings.

5.3 As a User booking a parking space ("Renter"), you agree to:

• use the parking space only for lawful vehicle parking;
• not sublease or transfer your booking to others;
• follow any access instructions and building rules provided;
• leave the parking space in the same condition as found.

6. Payments

6.1 The Platform does not process, facilitate, or handle payments between Users. All payments in relation to bookings, including any rent and security deposits, are arranged and made directly between Landlords and Renters outside of the Platform.

6.2 All payment obligations arise solely between Users. The Platform is not a party to any transaction between Users and bears no responsibility or liability in respect of any payments, including any failure, delay, or dispute.

6.3 The Platform charges service fees only to Landlords for the use of the Platform, as may be agreed separately or specified on the Platform.

6.4 Any refunds, cancellations, or payment disputes are strictly between Users, and the Platform is under no obligation to mediate or resolve such matters.

7. User Obligations

7.1 Users agree to use the Platform in compliance with applicable laws and regulations.

7.2 Users shall not:

• provide false or misleading information;
• use the Platform for unlawful purposes;
• interfere with the operation or security of the Platform.

8. Liability

8.1 The Platform provides its services on an "as is" and "as available" basis.

8.2 To the maximum extent permitted by law, the Platform shall not be liable for:

• any indirect or consequential losses;
• disputes between Users;
• the condition, legality, or availability of parking spaces;
• any acts or omissions of Users;
• payment disputes or failures between Users.

8.3 Nothing in these Terms excludes liability where such exclusion is not permitted by law.

9. No Agency or Partnership

9.1 Nothing in these Terms shall be construed as creating any partnership, joint venture, agency, fiduciary, or employment relationship between the Platform and any User, or between Users.

9.2 The Platform acts solely as an independent technology provider and does not act as an agent, intermediary, broker, or representative of any User.

9.3 No User has any authority to act on behalf of, bind, or incur any obligation for or on behalf of the Platform.

9.4 Each User acts in their own name and on their own behalf in relation to any arrangements, bookings, or transactions made through the Platform.

10. Suspension and Termination

10.1 The Platform may suspend or terminate access to the Platform at any time in case of breach of these Terms or for operational reasons.

10.2 Users may stop using the Platform at any time.

11. Intellectual Property

11.1 All intellectual property rights in the Platform are owned by or licensed to the Platform.

11.2 Users may not copy, modify, or distribute any part of the Platform without prior written consent.

12. Governing Law

12.1 These Terms shall be governed by the laws of the United Arab Emirates.

12.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, unless otherwise required by applicable law.
